These Terms of Service ("Terms") govern your use of the Skye mobile application ("App") operated by Signull Labs Inc., a Delaware corporation ("Company," "we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.
By accessing or using Skye, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our App.
Skye is a personal AI assistant that provides personalized morning briefings by analyzing data from your connected services including Gmail, Calendar, Spotify, Apple Health & Fitness, Reminders, and financial accounts through Plaid. The App generates audio updates and learns your preferences to improve future briefings.
You must be at least 13 years old to use Skye. By using our App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4.1 Account Creation: You may need to create an account and connect various third-party services to use Skye's features.
4.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.3 Third-Party Integrations: Skye integrates with third-party services. You are responsible for maintaining valid accounts with these services and complying with their respective terms of service.
You agree to use Skye only for lawful purposes and in accordance with these Terms. You agree not to:
6.1 Our Rights: Skye and all related technology, including but not limited to software, algorithms, user interfaces, and audio content, are owned by Signull Labs Inc. or our licensors and are protected by intellectual property laws.
6.2 Your Data: You retain ownership of your personal data. By using Skye, you grant us a limited license to process your data solely to provide our services as described in our Privacy Policy.
6.3 Generated Content: Audio briefings and memories generated by Skye based on your data are provided for your personal use only.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8.1 Current Offering: Skye is currently offered free of charge. We reserve the right to introduce paid features or subscriptions in the future with appropriate notice.
8.2 Service Modifications: We may modify, suspend, or discontinue any aspect of Skye at any time, with or without notice.
8.3 No Warranty: We provide Skye "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
9.1 OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO SKYE SHALL NOT EXCEED $100.
9.2 WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9.3 WE ARE NOT RESPONSIBLE FOR ANY DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY SKYE.
You agree to indemnify, defend, and hold harmless Signull Labs Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of Skye or violation of these Terms.
11.1 By You: You may stop using Skye at any time by deleting the App from your device.
11.2 By Us: We may terminate or suspend your access to Skye immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business.
11.3 Effect of Termination: Upon termination, your right to use Skye ceases immediately. Data retention after termination is governed by our Privacy Policy.
12.1 Governing Law: These Terms are governed by Delaware law, without regard to conflict of law principles.
12.2 Arbitration: Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in New York, NY.
12.3 Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.
We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of Skye after such changes constitutes acceptance of the new Terms.
